Welcome to www.hinchitandconsulting.com (the "Site"), operated by Hinch IT & Consulting ("we," "us," or "our"). By accessing or using the Site, or by engaging our services, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site or our services.
Hinch IT & Consulting provides home-visit IT support and consulting services to residential clients in the East Valley, Arizona area, including Gilbert, Chandler, Mesa, Queen Creek, and San Tan Valley. Services and pricing are discussed and agreed upon directly with each client, typically after an initial inquiry through the Site's contact form or by phone.
You agree to use the Site only for lawful purposes. You may not:
Submitting an inquiry through our contact form does not create a binding agreement for services. A service engagement begins only once we have communicated directly with you and agreed on the scope of work, pricing, and scheduling.
Pricing is quoted to you directly — either as a flat rate for the service requested or an hourly rate of $85 per hour — before or at the time services are scheduled. Any change in scope discovered during the visit will be communicated to you before additional charges are incurred.
Unless otherwise agreed in writing, payment is due upon completion of service. We accept cash, Venmo, or Zelle. Invoices not paid within 30 days of the service date are considered past due and may be subject to a late fee of 10% per month on the outstanding balance (maximum of 6 months). We reserve the right to decline future service requests from clients with an unpaid balance.
We stand behind our work with a 30-day guarantee on the specific issue we were engaged to resolve. If the same issue recurs within 30 days of the original service date due to our workmanship, we will return to address it at no additional charge.
This guarantee does not cover:
To determine whether a recurrence is covered, we will consider: whether the issue matches the same diagnosis and symptoms documented at the original visit, whether the timeframe falls within 30 days of the original service, and whether there is evidence of an intervening cause (such as new downloads, disabled security settings, or third-party access) that would point to a new issue rather than a recurrence of the original one. We'll walk you through our findings if a claim is denied. This guarantee applies to the specific service performed and does not extend or restart with any follow-up visit.
Our services are provided on an "as-is" and "as-available" basis. While we bring over 20 years of IT experience to every job, we do not guarantee that any particular issue can be fully resolved, that all software or hardware will function without error afterward, or that data will not be lost during troubleshooting or repair.
Backing up your data before any service visit is your responsibility. We strongly recommend that you back up all critical files, photos, and data before we begin work, and we will remind you of this at the time of scheduling. If you are unsure how to do this, let us know and we can advise or assist. We are not responsible for data loss that could have been prevented by a backup made prior to the service visit.
To the fullest extent permitted by Arizona law, Hinch IT & Consulting shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or the Site, including but not limited to data loss, hardware damage, or business interruption, except to the extent caused by our gross negligence or willful misconduct.
To the extent any liability is not excluded above, our total liability to you for any claim arising from a given service visit — whether based on contract, negligence, or any other legal theory — is limited to the amount you paid us for that specific service visit. This cap does not apply to damages caused by our gross negligence or willful misconduct.

We may update these Terms from time to time. The "Effective Date" above reflects the date of the most recent revision. For minor or non-material changes, continued use of the Site after changes are posted constitutes acceptance of the updated Terms. For material changes that affect an active or upcoming service engagement with you, we will make reasonable efforts to notify you directly (such as by email) before the changes apply to that engagement.
